Bruce E. Buchanan is an attorney
in the Labor and Employment Discrimination Sections of King & Ballow.
Mr. Buchanan received his law degree from the Vanderbilt University School
of Law and his undergraduate degree from Florida State University,
graduating magna cum laude with a Bachelor of Science degree in Government.
This course is intended as an in-depth overview of the Americans
with Disability Act (ADA).
It is intended for the individual who wants a basic understanding of ADA and for the experienced Employment Law attorney
who desires an update on recent cases under ADA. It focuses on decisions from the
Courts of Appeals as well as the U.S. Supreme Court. It also
covers many areas, including the following: (1) types of prohibited
discrimination; (2) what is a disability; (3) who is a qualified individual
and the ability to perform the essential job functions; (4) what is a
reasonable accommodation; (5) determining whether an individual is
substantially impaired in a "major life activity;" (6) employer
defenses -- direct threat and undue hardship; (7) "regarded as"
disabled; (8) "safe harbor" for addicts in recovery; (9)
retaliation; and (10) remedies.
