Retaliation Claims Under Title VII

 

 

David Hudson serves as an attorney for the First Amendment Center at Vanderbilt University in Nashville, Tennessee. The Center, which is funded by the Freedom Forum, seeks to foster a greater public understanding and appreciation for First Amendment rights and values. Hudson writes for the Freedom Forum's online publication, The Freedom Forum Online, and other leading publications devoted to First Amendment issues. He contributes regularly to the American Bar Association's Preview of United States Supreme Court Cases, the Commercial Speech Digest and the ABA Journal.

Many times employees allege employers take action against them in retaliation for complaining about discrimination in the workplace. Employers must understand that they can be liable for retaliation in certain situations even if the employee's underlying discrimination claim is weak. This means that employers and employees alike need to understand the nuances of Title VII retaliation cases. This online course covers the basics of retaliation claims from what is an adverse employment action to the requirement of causation. Following the initial presentation, participants will receive 15 hypothetical questions taken from real appellate cases. These hypothetical questions are designed to reinforce and add to the initial presentation.
