Every lawyer, whether transactional or litigation
oriented, must resolve ethical issues on a regular basis. When such issues
are raised, the lawyer may find himself or herself having to make a
judgment call. Unfortunately, lawyers are not governed by one set of
ethical rules.
In fact, if a lawyer is faced with an ethical dilemma while involved
in a multi-state transaction, he or she must look to the ethical rules of
the jurisdiction where he or she is licensed and where he or she is engaged
in the practice of law because a lawyer's conduct may be governed by both
sets of rules. These materials focus primarily on the Model Rules of
Professional Conduct (the "Model Rules"), drafted by the American
Bar Association ("ABA"), because
most of the states, including Texas,
have adopted the Model Rules.
This course examines issues every lawyer should know. The
participant will be lead through a series of hypothetical situations with
court decisions as a guide.
